As authorised by the Ministry of Youth and Sports and in line with the current and enforceable laws, orders, regulations and guidelines in Malaysia particularly the Prevention and Control of Infectious Diseases Act 1988, Prevention and Control of Infectious Diseases (Declaration of Infected Local Areas) Order 2020, Prevention and Control of Infectious Diseases (Measures within the Infected Local Areas) Regulations 2020 (collectively referred to as the “Movement Control Order”), this campaign is organized by Impact Malaysia in order to deliver aid to the Beneficiaries (as defined in paragraph 1.3 below).
Impact Malaysia may involve third party service providers (“partners”) to deliver and provide aid to the Beneficiaries, where Impact Malaysia acts only as an intermediary between the partners and aid providers. As such, Impact Malaysia shall not be held responsible nor liable for the acts, commissions, omissions, negligence whatsoever of the partners in any way whatsoever.
Impact Malaysia and partners will have the discretion to determine the individuals or groups of people that will be receiving aid through this campaign (“Beneficiaries”) and reserves the right to change that decision at any point throughout this campaign.
Impact Malaysia reserves the right to accept or reject projects and collaborations offered at our discretion.
Personal Information
All photographs, personal information and names submitted to Impact Malaysia via the Campaign shall be the property of Impact Malaysia and unless, expressly stated otherwise in writing to Impact Malaysia, all necessary consents under the relevant laws in respect of personal data protection shall be deemed granted in favour of Impact Malaysia.
Impact Malaysia in collecting personal information throughout the campaign will adhere to local privacy laws, regulatory requirements and guidance as updated and amended from time to time.
Limitations of Liability
The partners and aid providers shall be responsible and fully liable and shall fully indemnify Impact Malaysia against any claims, charges, legal proceedings, liabilities whatsoever arising from, in connection with or related to their respective acts, commissions, omissions, negligence whatsoever.
Impact Malaysia shall not be liable for any claims or losses of any nature whatsoever, including but not limited to, loss of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with this Campaign.
Impact Malaysia shall also not be liable in the event that any collaborations or projects ceases to become viable due to any change whatsoever which including without limitation to the decision of Impact Malaysia, introduction of further restriction under the Movement Control Order by the Malaysian National Security, and any relevant advisory by the Ministry of Health, Malaysia.
